General Terms and Conditions (GTC)
for the SONAIRE STUDIO online shop
1. Scope
(1) These General Terms and Conditions apply to all contracts concluded between

– hereinafter referred to as "Seller" –
and consumers within the meaning of § 13 BGB via the SONAIRE STUDIO online shop.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
(3) Sales are made exclusively to consumers.

3. Subject of the Contract
(1) The subject of the contract is the sale of goods via the online shop.
(2) The product range includes, in particular:

Home and decorative items
-
Furniture and small furniture
-
Lamps and lighting
-
Jewellery
-
Accessories
-
Clothing
-
Design and lifestyle products
-
Works of art
-
Hand-painted pictures and unique items
(3) The respective product characteristics can be found in the product descriptions in the online shop.
4. Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but an non-binding invitation to place an order.
(2) By clicking the "Buy now", "Buy" button, or a similar order button, the customer submits a binding offer to conclude a purchase agreement.
(3) The seller can accept the offer within five working days by:

sending an order confirmation,

shipping the goods, or
-
requesting payment.
(4) The contract text will be saved after the contract is concluded. The customer receives the order data by email.
5. Prices
(1) All prices are in Euro, including statutory VAT.
(2) Additional shipping costs will be shown separately.
(3) The prices stated in the shop at the time of the order are decisive.
6. Payment Methods

The seller reserves the right to exclude individual payment methods in specific cases.
7. Delivery
(1) Delivery takes place within Germany and to member states of the European Union.
(2) Delivery is made to the delivery address specified by the customer.
(3) Delivery times can be found in the respective product description.
(4) If ordered products are temporarily unavailable, the customer will be informed immediately.
8. Retention of Title
The goods remain the property of the seller until full payment.
9. Special Notes on Handcrafted Products and Works of Art
(1) Handcrafted products, works of art, hand-painted pictures, and other unique items are regularly one-of-a-kind pieces.
(2) Minor deviations in terms of colour, structure, surface texture, brushwork, material structure, or representation on digital devices do not constitute a defect, provided that the deviations are typical and reasonable for handcrafted unique items.
(3) Product images are for illustration purposes. Colour deviations may occur due to different screen displays.
10. Warranty
The statutory warranty rights apply.
11. Liability
(1) The seller is liable without limitation:

in case of intent and gross negligence,
-
in case of injury to life, body, or health,
-
according to the Product Liability Act,
-
to the extent of assumed guarantees.
(2) In case of slight negligence in violating essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.
(3) Otherwise, liability is excluded to the extent permitted by law.
12. Right of Withdrawal
Consumers have the statutory right of withdrawal.

13. Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected.
14. Consumer Dispute Resolution
The European Commission provides a platform for online dispute resolution:

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
